These Terms of Use (the Terms) govern your access to and use of peakdentalutah.com and any pages, forms, portals, emails, texts, or content we operate or control (collectively, the Site). The Site is provided by Peak Dental Utah (Peak Dental, we, us, our), located at 5872 900 E #252, Murray, UT 84107.
By accessing or using the Site, you agree to these Terms and to all applicable laws. If you do not agree, do not use the Site.

We may update these Terms at any time by posting a revised version on the Site and updating the Effective Date. Your continued use after changes are posted means you accept the updated Terms.
2) Eligibility and Compliance
You are responsible for ensuring your use of the Site complies with all applicable laws, rules, and regulations. Accessing the Site from jurisdictions where the Site or its content is illegal is prohibited.
3) No Medical or Dental Advice
Content on the Site is for general informational purposes only and is not a substitute for professional diagnosis, advice, or treatment. Always seek the advice of a dentist or qualified health provider regarding a dental condition. Reliance on any Site content is at your own risk.
4) Privacy; HIPAA
Your use of the Site is subject to our Privacy Notice. When we create, receive, or maintain protected health information (PHI) in connection with care, our HIPAA Notice of Privacy Practices governs. Both notices are available in our office and linked in the Site footer.
5) Intellectual Property
The Site, including text, graphics, logos, icons, photos, videos, software, and other materials, and all associated intellectual property rights, are owned by Peak Dental or our licensors and are protected by U.S. and international laws. We reserve all rights not expressly granted.
You may view the Site for your personal, noncommercial use. You may not copy, reproduce, modify, distribute, publicly display, publicly perform, translate, create derivative works from, or otherwise exploit the Site or its content without our prior written permission. All trademarks, service marks, and logos displayed on the Site are the property of their respective owners.
6) User Accounts and Security
If you create an account or use any portal:
You must provide accurate information and keep it current.
You are responsible for maintaining the confidentiality of your credentials and all activities that occur under your account.
Notify us immediately of any unauthorized access or use.
We may suspend or terminate access for any actual or suspected violation of these Terms.
7) Acceptable Use; Prohibited Conduct
You agree not to:
Interfere with, disrupt, or attempt to gain unauthorized access to the Site or related systems.
Upload or transmit viruses, malware, or harmful code.
Collect or harvest information about others without consent.
Post or transmit content that is unlawful, infringing, defamatory, misleading, harassing, or otherwise objectionable.
Infringe the intellectual property, privacy, or other rights of Peak Dental or third parties.

If you submit, upload, post, or otherwise provide content (User Content), you grant Peak Dental a worldwide, nonexclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, publish, display, distribute, and create derivative works from the User Content in connection with the Site and our business, including marketing and promotion, in any media now known or later developed.
You represent and warrant that you own or control all rights in and to your User Content, that it is accurate and lawful, and that its use by Peak Dental will not violate the rights of any person or entity or any law. Do not include PHI or others’ personal information in User Content. We may remove or decline to use any User Content at any time.
If you believe content on the Site infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to info@peakdentalutah.com.
9) Third-Party Links and Services
The Site may link to third-party sites, tools, or services we do not control. We are not responsible for third-party content, policies, or practices. Access and use them at your own risk.
10) Appointment Reminders; Electronic Communications; SMS
By providing your contact information, you consent to receive communications from us, including emails, phone calls, and texts regarding appointments, confirmations, reminders, and patient communications. Promotional emails may be unsubscribed via the link in the email. To stop promotional texts, reply STOP; for help, reply HELP. Message and data rates may apply. Consent is not a condition of receiving care or services. See our Privacy Notice for details.
11) Disclaimers
Site Content and Availability
The Site and its content are provided for convenience and may include errors, omissions, or inaccuracies. We may update or change content at any time without notice. We do not warrant that the Site will be uninterrupted, secure, or error-free.

12) Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PEAK DENTAL AND ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE THOUSAND DOLLARS (USD $1,000) IN THE AGGREGATE.

14) Governing Law; Venue
These Terms and your use of the Site are governed by the laws of the State of Utah, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Salt Lake County, Utah for all disputes arising out of or relating to these Terms or the Site. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
15) Suspension and Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, the license granted to you ends immediately.
16) Severability; Waiver; Entire Agreement
If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver. These Terms constitute the entire agreement between you and Peak Dental regarding the Site and supersede all prior or contemporaneous communications regarding the Site.
